U-JUST-EAT is a company registered in England and Wales with registered company number 04656315, whose registered office is at 35 Catherine Place, London, SW1E 6DY.

 

 

1.1 U-JUST-EAT has established a points reward scheme whereby you can collect points for every order placed through this Website (the “Scheme”). Subject to these T&Cs, all members of U-Just-Eat.co.uk are eligible to participate in the Scheme.

 

1.2 U-JUST-EAT reserves the right to suspend or terminate your points reward account and/or cancel reward points collected for any good reason (e.g. if you breach a material clause of these T&Cs) at any time. For further details regarding our termination and suspension rights please refer to clause 3 (Variation, Termination or Suspension of the Scheme) of these T&Cs below.

 

1.3 U-JUST-EAT reserves the right to vary the points that can be collected on placement of orders; withdraw or vary any offer or products that are published on the Pointshop page (“Rewards”); or amend these T&Cs at any time. We advise you to check this Website regularly in order to keep yourself updated with any changes to the Scheme or these T&Cs.

 

 

2.1 Once you have registered as a member, you will be able to collect points whenever you make an order through this Website. Points are awarded on the basis of the value of your order.

 

2.2 Points collected cannot be transferred to another person, members’ account or company. In addition, reward points do not constitute your personal property and do not have monetary value and therefore you may not exchange points for cash or money.

 

2.3 You can view your points account balance by logging into the Pointshop page http://www.u-just-eat.co.uk/pointshop. U-JUST-EAT will correct a points account if you can show to our reasonable satisfaction that it is inaccurate. However, in the absence of records proving this, U-JUST-EAT’s decision is final.

 

2.4 It is possible that, despite U-JUST-EAT’s best efforts, some of the Rewards displayed on this Website have the incorrect number of requisite points displayed next to them. If this comes to U-JUST-EAT’s attention when you redeem your points in exchange for the Reward, we will either contact you, or reject your order and notify you of such rejection. U-JUST-EAT is under no obligation to provide a Reward to you, even if we have sent you dispatch confirmation, if the points error is obvious and unmistakable and could have reasonably been recognised by you as an error.

 

2.5 When you have collected a sufficient number of points you can redeem them in exchange for a Reward. Please refer to the points page on this Website in order to find out how your pounds spent on orders are converted into points.

 

2.6 You may only spend your points on Rewards that are published on the Pointshop page http://www.u-just-eat.co.uk/ . We reserve the right to change the number of points required for a particular Reward at any time. For the avoidance of doubt you may only redeem points for Rewards published on this Website Pointshop and not on our other international U-JUST-EAT website pointshops.

 

 

3.1 U-JUST-EAT reserves the right to terminate the Scheme at any time. Before we do this, we will publish our intention to terminate on this Website and will provide you with a reasonable period of time in which you will have an opportunity to redeem your points. After this period has expired, your points account will be cancelled and you will not be able to redeem your points. It is important that you regularly check this Website for latest information and updates regarding the Scheme.

 

3.2 U-JUST-EAT has the right to close any points account on which no points have been earned or redeemed for a continuous period of 12 months. With regard to “active” accounts, you will have a period of 18 months in which to redeem points accrued in your points account. Points accrued will automatically expire after 18 months and your right to redeem these points shall be lost. Please note that these time limits may change at any time and we advise you to check this Website for up to date information about these time limits and other important information about the Scheme.

 

3.3 If you cancel your membership to U-Just-Eat.co.uk then U-JUST-EAT may close your account and shall have the right to cancel all accrued points on your account.

 

 

4.1 If you select a Reward that has been withdrawn then you may have your points in relation to that Reward reinstated or to select an alternative Reward with an equivalent or lesser points value.

 

4.2 Once U-JUST-EAT has received your request to redeem your points we will send you notification by e-mail that either the Reward in question is in stock and will be delivered to you or informing you that the Reward selected is unavailable.

 

4.3 When you receive an e-mail from us confirming that the Reward selected is in stock and has been dispatched, you will not be able to cancel your order placed for the Reward.

 

4.4 U-JUST-EAT will only deliver Rewards to UK addresses. Unless otherwise stated, delivery is free and will normally take place within 30 days from the date dispatch confirmation. The Reward will be at your risk from the time of dispatch and ownership will pass to you once the Reward has been delivered and received by you.

 

4.5 U-JUST-EAT will deliver the Reward to the address that you entered when you registered with us. It is your responsibility to update us with any change of address.

 

4.6 Subject to certain representations implied by law, U-JUST-EAT makes no representations regarding the quality of the Rewards. However, if you are unhappy with your Reward, you can return it at your own cost within 30 days of delivery. Provided that you return the Reward in the same condition as you received it, U-JUST-EAT will reinstate your points or send a replacement Reward of an equivalent value as selected by you. Please note that postage and packing of the replacement Reward will be payable by you.

 

 

5.1 The majority of the Rewards displayed on the Pointshop are supplied by our third party supplier partners (“Supplier Partners”). By redeeming points, you shall release U-JUST-EAT, its parent company and its subsidiaries from all liability arising from the Reward (including a failure by the Supplier Partner to honour a redemption or to make a specific Reward available). The Rewards are subject to any additional terms and conditions (including warranties and limitations of liability) of the Supplier Partners. In particular, please note that where points are redeemed in return for a voucher or ticket, the voucher or ticket may have an expiry date specified and may also be subject to additional terms and conditions.

 

5.2 With regard to Rewards consisting of U-JUST-EAT merchandise (such as T-shirts, E-vouchers and key hangers brandishing the U-JUST-EAT logo) and to your participation in the Scheme generally:

 

5.2.1 U-JUST-EAT, and any of our group companies and the officers, directors, employees, shareholders or agents of any of them, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, or loss or damages arising from or connected in any way to business interruption, loss of opportunity, loss of anticipated savings, wasted management or office time and whether in tort (including negligence), contract or otherwise, even if forseeable) in connection with the Scheme and Rewards that you select.

 

5.2.2 Nothing in these T&Cs excludes or limits U-JUST-EAT’s liability for death or personal injury arising from U-JUST-EAT's negligence, nor U-JUST-EAT's liability for fraudulent misrepresentation, nor U-JUST-EAT’s liability in respect of your statutory rights, nor any other liability which cannot be excluded or limited under applicable law.

 

5.2.3 With the exception of any liability referred to in clause 5.2.2 above, U-JUST-EAT’s total liability to you in relation to the Scheme and the Rewards including (but not limited to) liability for breach of these T&Cs and tort (including but not limited to negligence) is limited to £100.

 

 

6.1 U-JUST-EAT will process information gathered from you pursuant to the Scheme in accordance with the U-JUST-EAT privacy policy

 

6.2 Nothing contained in these T&Cs affects your statutory rights.

 

6.3 If any provision of these T&Cs is held to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these T&Cs and shall not affect the validity and enforceability of any remaining provisions.

 

6.4 Any failure or delay by you or us in enforcing (in whole or in part) any provision of these T&Cs will not be interpreted as a waiver of your or our rights or remedies.

 

6.5 You may not transfer any of your rights or obligations under these T&Cs. We may transfer any of our rights or obligations under these T&Cs without your prior written consent to any business that we enter into a joint venture with, purchase or are sold to.

 

6.6 The headings in these T&Cs are included for convenience only and shall not affect their interpretation.

 

6.7 These T&Cs shall be governed by and construed in accordance with English law. Disputes arising in connection with these T&Cs (including non-contractual disputes) shall be subject to the exclusive jurisdiction of the English courts.
